These Terms of Service (“Terms”) govern your use of the websites, games, and services operated by FociiGames Inc. (“FociiGames”, “we”, “us”), including GladFights, ClanFights, DustClans, Hexball, ClanFights Survivor, Hubbletown, and any other titles we operate (together, the “Services”). Individual games may publish additional game-specific rules; where they conflict, the game-specific rules govern for that game.
1. Who we are
The Services are operated by FociiGames Inc., a company based in British Columbia, Canada. Our contact address for all matters relating to these Terms is info@fociigames.com.
2. Accepting these terms
By creating an account, signing in, or otherwise using any of the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
3. Eligibility & age
You must be at least 13 years old (or the higher minimum age required by your local law — for example 16 in much of the European Union) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or legal guardian who agrees to be bound by these Terms on your behalf. Our Services are not directed to children under 13.
4. Your account
- You are responsible for keeping your credentials confidential and for all activity on your account. Contact us immediately if you believe your account has been compromised.
- You agree to provide accurate registration information and keep it current.
- You may operate one account per person per game unless we explicitly authorise otherwise.
- We may suspend or close accounts that violate these Terms or applicable law.
5. Acceptable use
You agree not to:
- Use bots, scripts, automation, or unauthorised third-party software to play, gain advantage, or extract data.
- Reverse-engineer, decompile, disrupt, or interfere with our servers or security.
- Buy, sell, or trade accounts or in-game items for real-world value outside official channels we provide.
- Harass, threaten, defraud, or impersonate other players or our staff.
- Submit content that is unlawful, hateful, sexually explicit involving minors, infringing, or otherwise objectionable.
- Exploit bugs for unfair advantage or otherwise undermine the integrity of a game.
We may remove content, withhold purchases, and suspend or terminate accounts that break these rules.
6. Virtual currency & items
Our games may include virtual currencies (for example, in-game coins, gold, or “nuggets”), premium memberships, and other virtual items (together, “Virtual Items”).
- Virtual Items have no monetary value, cannot be redeemed for cash, and cannot be transferred outside the relevant game.
- You receive a limited, personal, non-transferable, revocable licence to use Virtual Items inside the game. You do not own them.
- We may modify, expire, or remove Virtual Items as part of normal balancing or maintenance. We will not retroactively remove Virtual Items you paid for except where required by law, or in cases of fraud or breach of these Terms.
- If we permanently close a game, unused paid Virtual Items may expire. We will give reasonable advance notice and, where required by law, refund unused paid balances.
7. Purchases
Purchases are processed by our payment partners (currently Stripe and PayPal). You also agree to those partners’ terms. Prices and applicable taxes are shown at checkout.
All purchases are one-time and delivered instantly to your account — our games do not auto-renew or bill you on a recurring schedule. Refund terms, and how to make a request, are set out in our Refund Policy. If a payment is reversed (refund, dispute, or chargeback), the corresponding Virtual Items and/or premium time may be deducted from your account.
8. Intellectual property & your content
The Services, including artwork, code, audio, and trademarks, are owned by FociiGames or our licensors and are protected by law. We grant you a limited, personal, non-transferable licence to use the Services for their intended purpose.
When you submit content (such as player names, clan names, messages, forum posts, or profile text), you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute it as part of operating the Services. You retain ownership of your own content, and you are responsible for it. We may remove content that breaks these Terms or applicable law.
9. Availability & changes
We work to keep the Services running but do not promise continuous, uninterrupted, or error-free operation. We may take the Services offline for maintenance; change game mechanics, balance, content, prices, and features; and discontinue features or entire games (subject to section 6).
10. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, if your account is fraudulent or compromised, or if we reasonably believe action is needed to protect other players or the Services. On termination, your right to use the Services and Virtual Items ends. Sections that by their nature should survive (6, 7, 8, 11, 12, 13) survive.
11. Disclaimers & limitation of liability
To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind. To the maximum extent permitted by law, FociiGames’ total liability arising out of or relating to these Terms or the Services is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) CAD 100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Consumer rights
Nothing in these Terms removes or limits mandatory legal rights you have as a consumer under the law of your country or region — including, where applicable, the British Columbia Business Practices and Consumer Protection Act, other Canadian consumer law, and the statutory rights of consumers in the EU, the UK, and elsewhere. Where a term conflicts with a mandatory consumer right that applies to you, that right prevails.
13. Governing law & disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts located in Vancouver, British Columbia have jurisdiction, except that if you are a consumer you may also bring proceedings in the courts of your place of residence where local law gives you that right.
14. Changes & contact
We may update these Terms. When we do, we will change the “Last updated” date above and, for material changes, give reasonable notice in-game or by email. If you do not agree to the updated Terms, please stop using the Services. Questions? Email info@fociigames.com.
